Secretary of the Council and Head of BPKAD Flirt, Kuningan Regent Dragged Back in Payment of 2026 DPRD Allowances

Kuningan, Konntroversinews | The issuance of the Kuningan Regent’s Decree Number 900/KPTS.413-SETWAN/2025 as the legal basis for the payment of DPRD Allowances for 2025, even though it is wrong because it should use the Regent’s Regulation (Perbup) in accordance with the legal provisions as regulated in PP Number 18 of 2017, is a harsh blow to policy makers. This reflects the weak leadership of the legislative and executive leaders in administering the government. The carelessness above shows the weakness of the Kuningan Regency Government and DPRD institutions as elements of regional government administration. Executives have the function of being responsible and implementing government administration. Meanwhile, the DPRD constitutionally has three functions, namely Legislation, Budget and Supervision. So, in planning, drafting, discussing and determining the Kuningan APBD, the legislative and executive parties should not make mistakes with their good performance. Even though they have been given harsh criticism and even demonstrations, both the executive and legislative have not changed, even challenging the legal process for going to prison collectively or in congregation. Ironically, it is not only 2025 that is problematic, the payment of DPRD allowances for 2026 is also the same.

On February 10 2026, DPRD Secretary Deni Hamdani sent a letter number: 900/79/Setwan to the Head of BPKAD Deden Kurniawan with an important nature regarding the Request for Proposed Input Details of Unit Price Standards (SHS) of Salaries and Allowances for DPRD Leaders and Members in the 2026 SIPD-RI Application. can be included in the SIPD-RI Application for the 2026 budget year as a basis for budget absorption. The Secretary of State said that the 2026 SHS proposal should be guided by PP No. 18 of 2017 which was changed to PP No. 1 of 2023 concerning Financial and Administrative Rights of DPRD Leaders and Members. It is also stated that it refers to Perbup No. 371 of 2022 concerning Regional Financial Capability which is used as the basis for determining the provision of Communication Allowances (TKI) and Recess Allowances as well as Operational Funds for the Kuningan Regency DPRD in 2023. This is very fatal, disbursement using regulations that have expired. The disbursement of DPRD allowances for February 2026 was detained by BPKAD because there was no legal umbrella for its legality. The Regional Regulation in question has not yet been finalized because it is still being discussed by the Legal Department.

Previously, carelessness was also shown by the DPRD Secretary and the Head of BPKAD who paid DPRD Allowances for the 2026 budget year from the APBD even though there was no legal umbrella at all, whether using the Kuningan Regent’s Decree, let alone the Regent’s Regulation. Referring to SP2D data number 32.08/04.0/000003/LS/4.02.0.00.0.00.28.0000/M/1/2026 based on a proposal from Imam Safei Muslim, S.AK as Treasurer, Setwan Expenditures for Salary and Allowance Expenditures for DPRD Leaders and Members have been disbursed on January 2 2026 which are charged to the Budget Post Implementation of DPRD Financial Administration with the following details:

The erroneous issuance of the Kuningan Regent’s Decree regarding DPRD Allowances cannot be separated from the administrative role created by the DPRD Secretariat. Where in this case the DPRD Secretary as the Budget User (PA) at the DPRD Secretariat was careless by creating and including the DPRD Allowance budget in the Budget Implementation Document (DPA) in the Kuningan APBD because of a mistake they themselves made in never wanting to submit a Regent’s Regulation. The DPA is described in the APBD and is the legal basis for implementing activities and using the budget by budget users. The DPA is an elaboration of the Work Plan and Budget (RKA) document. This is where it is important for the legislative body represented by the DPRD Secretariat administratively in technical budget management to have an understanding and compliance with the rules because evidence of errors in making the DPA and RKA can be dealt with by law enforcement officials (APH).

We strongly protest against the Regent of Kuningan, Dr. Dian Rachmat Yanuar, M.Si, who neglected his subordinates, namely Regional Secretary U. Kusmana as Chair of TAPD, Head of BPKAD Deden Kurniawan Sopandi and DPRD Secretary Deni Hamdani played with fire, including administrative input for the preparation of Unit Price Standards (SHS) regarding details of allowances for DPRD leaders and members in the SIPD-RI Application for the 2026 budget year as the basis for budget absorption. It is almost certain that this deliberate carelessness will become a finding of the Financial Audit Agency (BPK) and will later result in them being investigated by Law Enforcement Officials (APH). The strong fact that mens rea or misuse of the APBD has occurred can be proven, where the DPRD Secretary and the Head of BPKAD do not follow or use provisions that are official and legal references in paying DPRD Allowances. The Regent of Kuningan should immediately process the drafting of a Regent’s Regulation (Perbup) instead of involving himself in being held accountable for allowing the legality of DPRD Allowances to be problematic.
